Basketball Arbitral Tribunal is introducing a new Payment Order Procedure

The Basketball Arbitral Tribunal based in Geneva, Switzerland, announced through an official statement that it has implemented a new simplified procedure called “payment order procedure” in its arbitration rules.

According to the arbitration rules, which will enter into force on February 1, 2024, the procedure is comparable to that of Regulation (EC) no. 1896/2006 of the European Parliament and of the Council of 12 December 2006 and it represents the first procedure of this kind implemented by a sports arbitration tribunal.

This procedure provides for the BAT to issue a payment order for a monetary claim up to 15.000 EUR at a claimant’s request without examining the merits of the claim if some basic requirements are fulfilled and the claim is not contested by the respondent. The final payment order shall have the effects of a final and binding arbitral award between the parties and qualifies as a decision in the terms of Article 3-335 of the FIBA Internal Regulations.

The change comes as a result of the discussions held between the representatives of the Basketball Arbitral Tribunal and its users at the conference held in November 2022 in Munich, Germany, where the lawyers of our company Sabin Gherdan and Cristian Oană also participated (photo above).
